Terms of Service

1. Eligibility

The Services are intended only for users who are at least 18 years old, or the minimum legal age required by applicable law, whichever is higher. By using the Services, you represent that you meet this age requirement. We do not knowingly allow users below the applicable age to use the Services. This age restriction is consistent with our IARC content rating classification.

2. Limited License

Provided that you comply with these Terms, Ocular Point Inc. grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your own non-commercial entertainment. No rights are granted except those expressly stated in these Terms, and all other rights are reserved by Ocular Point Inc.

3. Acceptable Use

You agree that you will not:

• Use the Services for unlawful, misleading, fraudulent, abusive, or harmful activity.
• Interfere with, disable, overburden, or compromise the security or operation of the Services.
• Use cheats, exploits, bots, scripts, automation tools, modified clients, or unauthorized software.
• Attempt to access systems, accounts, data, or networks without authorization.
• Engage in conduct that we reasonably determine violates these Terms or harms the Services or other users.

4. Virtual Items and Optional Purchases

The Services may include optional digital items, features, chips, coins, tokens, credits, or similar content ("Virtual Items").

Purchase terms

• Purchases made through Google Play are subject to Google Play refund rules.
• Other purchases are final and non-refundable except where applicable law requires otherwise, including eligible rights under EU consumer laws.
• We may change pricing, availability, and item packages at any time.

Nature of Virtual Items

• Virtual Items have no cash value and no real-world monetary value.
• Virtual Items are digital entertainment content and do not represent money, property, winnings, or stored value.
• Buying or receiving Virtual Items gives you a limited, revocable license to use them only inside the Services. You do not own them.
• We may modify, manage, suspend, remove, or discontinue Virtual Items without liability, except where prohibited by law.

Prohibited transfers

• You may not sell, trade, gift, exchange, transfer, or assign Virtual Items to any other person.
• You may not buy, sell, or exchange Virtual Items through third-party platforms, websites, brokers, or services.
• You may not attempt to convert Virtual Items into currency, cryptocurrency, prizes, or anything of real-world value.
• Violations may result in termination without refund.

5. No Real-Money Gambling

The Services are for entertainment only. They do not offer real-money gambling, wagering, betting, cash prizes, or real-world payouts.

Users who participate in unauthorized trading or real-money exchange activity may have access permanently terminated.

6. Responsible Gaming

We encourage responsible play. Please set personal limits, take breaks, and stop playing if the Services no longer feel enjoyable.

7. Intellectual Property

The Services, including software, art, graphics, designs, interface elements, text, trademarks, logos, audio, animations, and other materials, are owned by or licensed to Ocular Point Inc. and are protected by intellectual property and other laws. You may not copy, modify, distribute, reproduce, publicly display, create derivative works from, or exploit any part of the Services without prior written permission from Ocular Point Inc.

8. Third-Party Services

The Services may include links to, advertising from, or integrations with third-party platforms, SDKs, stores, or services. Ocular Point Inc. does not control those third parties and is not responsible for their content, policies, availability, or practices. Your use of third-party services is governed by their terms and privacy policies.

9. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Ocular Point Inc. disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, compatible with all devices, or free from harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Ocular Point Inc. will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or unauthorized access, arising from or related to the Services or these Terms.

In no event will our total liability exceed the amount you paid to us, if any, during the twelve months before the claim arose. Nothing in these Terms limits liability where the law does not allow that limitation.

11. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access, with or without notice, if you violate these Terms, engage in prohibited activity, create risk for the Services or other users, or if termination is required for legal or security reasons.

Upon termination, you may lose access to Virtual Items and game progress, and no refund will be provided except where required by law.

12. Account Deletion and Local Data

The Services do not require account registration. Game progress and settings stored locally on your device are deleted when you uninstall the application. We do not provide a separate in-app account deletion feature because no registered account is required.

14. Updates to These Terms

15. Governing Law and Dispute Resolution

These Terms will be interpreted and enforced to the fullest extent permitted by applicable law. Any dispute, controversy, or claim relating to these Terms or the Services should first be addressed through good-faith negotiations between the parties.

If a dispute cannot be resolved through negotiation, either party may seek resolution in a court of competent jurisdiction or through any other lawful dispute resolution mechanism, to the extent permitted by law. Nothing prevents either party from seeking injunctive or equitable relief for intellectual property, unauthorized access, security, or other urgent matters.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
